Please read these Terms of Service carefully before engaging Legacy Built Homes for any construction, renovation, or related services. By requesting a quote, signing a contract, or proceeding with any project, you agree to be bound by these terms.


1. About Legacy Built Homes

Legacy Built Homes, operating as Legacy Built LTD, is a family-oriented custom home builder and renovation company based in Nelson, BC, serving the West Kootenays region — including Castlegar, Nelson, Nakusp, and Kootenay Bay. Founded in 2015 by Justin Creaser, we bring over 15 years of construction experience to every project.

These Terms of Service govern your use of our website at legacybuilthomes.ca and any engagement with our construction and renovation services. References to “we,” “us,” or “Legacy Built Homes” mean Legacy Built LTD.


2. Scope of Services

Legacy Built Homes offers the following services across the West Kootenays: custom home builds from site preparation and design collaboration through to final finishes; full home renovations including kitchens, bathrooms, family rooms, and whole-home transformations; home additions such as master suites, basement development, sunrooms, and garage expansions; framing and foundations; building envelope including weatherproofing and insulation suited to the Kootenays climate; general contracting with full project management from permits to final inspection; and windows, siding, interior finishing, and material selection guidance.

The specific scope of any project is defined in a written agreement signed by both parties prior to commencement. Services not listed in the project agreement are not included unless added via a written change order.


3. Quotes & Estimates

All quotes provided by Legacy Built Homes — whether delivered verbally, by email, or through our website — are non-binding estimates unless incorporated into a signed project agreement. We strive to provide accurate cost estimates and transparent pricing; however, final costs may vary based on site conditions, material availability, or changes to project scope.

Quotes are typically valid for 30 days from the date of issue. We reserve the right to revise a quote if material costs, labour rates, or project conditions change materially before a contract is signed.


4. Project Agreements

All construction and renovation work requires a written project agreement signed by both the client and Legacy Built Homes before any work begins. The project agreement will specify the scope of work, agreed price, payment schedule, estimated timeline, and any project-specific terms.

In the event of any conflict between these Terms of Service and a signed project agreement, the project agreement will take precedence. Legacy Built Homes reserves the right to decline any project or service request at its discretion.


5. Payment Terms

Payment schedules are established in each project agreement and typically follow a milestone-based structure. A deposit is required upon signing to secure your project start date. Progress payments are due at agreed milestones throughout the project. A final payment is due upon project completion and client sign-off at the final walkthrough.

Overdue payments may result in a suspension of work. Legacy Built Homes reserves the right to charge interest on overdue balances at a rate of 1.5% per month, or the maximum rate permitted by applicable law, whichever is less.


6. Project Changes & Change Orders

Any changes to the agreed scope of work — including additions, deletions, or substitutions — must be documented in a written change order and signed by the client before the change is implemented. Verbal agreements to change scope are not binding.

Change orders will include a description of the change, any adjustment to the project cost, and any impact on the project timeline. We will not proceed with out-of-scope work without written client authorization.


7. Timeline & Delays

Legacy Built Homes will provide estimated project timelines and will communicate proactively regarding the schedule. However, construction timelines may be affected by factors beyond our control, including weather conditions specific to the West Kootenays, delays in material supply or delivery, municipal permit processing times, changes to project scope requested by the client, and unforeseen site conditions.

Legacy Built Homes shall not be liable for delays caused by circumstances outside of its reasonable control.


8. Client Responsibilities

Clients agree to cooperate in good faith throughout the project. This includes providing timely site access during agreed working hours, making decisions on materials and finishes within agreed timelines, communicating concerns promptly, making payments according to the project agreement schedule, and ensuring the site is free of personal property or hazards that would impede construction.

Delays or additional costs resulting from the client’s failure to meet these responsibilities may be subject to additional charges and schedule adjustments.


9. Warranties & Workmanship

All labour and workmanship is warranted against defects for a period of one (1) year from the date of project completion, unless a longer period is specified in the project agreement. This warranty does not cover normal wear and tear, client or third-party modifications after completion, acts of nature, or failure of materials subject to a manufacturer’s own warranty.

Manufacturer warranties on materials and fixtures are passed through to the client and are subject to the respective manufacturer’s terms.


10. Limitation of Liability

To the fullest extent permitted by applicable law in British Columbia, Legacy Built LTD’s total liability for any claim shall not exceed the total amount paid by the client for the specific project giving rise to the claim. Legacy Built Homes shall not be liable for indirect, consequential, incidental, or punitive damages, including loss of use or cost of substitute accommodation. Nothing in these Terms limits liability for fraud, gross negligence, or personal injury caused by our direct actions.


11. Intellectual Property

All content on legacybuilthomes.ca — including text, photography, logos, and graphics — is the property of Legacy Built LTD and protected by applicable copyright and trademark law. You may not reproduce or use our content for commercial purposes without prior written consent.

Project photos may be used by Legacy Built Homes for portfolio and marketing purposes. If you prefer your project not be featured publicly, please notify us in writing prior to project commencement.


12. Website Use

Your use of legacybuilthomes.ca is for lawful purposes only. We are not responsible for the content or privacy practices of any third-party sites linked from our website. We reserve the right to modify or discontinue any part of our website at any time without notice.


13. Governing Law

These Terms of Service are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of British Columbia.
